minstrel: Copywrite Laws in Verse

Speaking of copyrights, can someone set me straight on when, if ever,
copyrights go away? When does something enter public domain? For
instance, the 'Happy Birthday' Song is, or at least was, copyrighted
(which is why you wouldn't hear it in restaraunts), but what about
something like Childe's Ballads? 'True Thomas' has been around for quite
some time, but I know that several people have taken it and 'Tam Lin' and
changed them around a bit. Do they have a copyright then on the new
words?
Finally, where does 'filk' fall under copyrights?
