Sounds like a Brewer's Choice package to me...
The 5 gallons are the maximum volume you can brew 
and still be confident your fermentation kicks in before any contaminating bacteria will (it's guaranteed though, good hygiene when brewing is always a good practice).  
Even if you're just brewing 9 pints, use the whole package.  It'll be easy enough to collect yeast for cultivating when the fermentation is done.
